Assault victim leaves hospitalAn 8-year-old girl who was hit in the head with a rock, reportedly thrown by her mother's boyfriend, is improving and has been released from a Brimingham hospital, authorities said.
Colbert County Sheriff Ronnie May said Kenneth Russell Herren, 26, 8773 Frankfort Road,
Tuscumbia, was charged with first-degree assault.
May said Herren is accused of throwing a large rock through the passenger window of a car and striking the child.
May said the incident took place Sunday afternoon outside a residence on Frankfort Road.
"The child's mother had been living with Herren and they were splitting up and she went to collect her belongings," May said. "While there, they got into an argument (and) she left with her children."
May said that after Herren was arrested, authorities discovered that he has outstanding warrants in Nevada for theft charges.
